**สัญญาประนีประนอมยอมความ บรรพ 3 เอกเทศสัญญา ลักษณะ 17<\/strong><\/p>\n**
**มาตรา 850<\/strong><\/p>\n**
อันว่าประนีประนอมยอมความนั้น คือสัญญาซึ่งผู้เป็นคู่สัญญาทั้งสองฝ่ายระงับข้อพิพาทอันใดอันหนึ่งซึ่งมีอยู่หรือจะมีขึ้นนั้นให้เสร็จไปด้วยต่างยอมผ่อนผันให้แก่กัน<\/p>\n
**มาตรา 851<\/strong><\/p>\n**
อันสัญญาประนีประนอมยอมความนั้น ถ้ามิได้มีหลักฐานเป็นหนังสืออย่างใดอย่างหนึ่งลงลายมือชื่อฝ่ายที่ต้องรับผิด หรือลายมือชื่อตัวแทนของฝ่ายนั้นเป็นสำคัญ ท่านว่าจะฟ้องร้องให้บังคับคดีหาได้ไม่<\/p>\n
**มาตรา 852<\/strong><\/p>\n**
ผลของสัญญาประนีประนอมยอมความนั้น ย่อมทำให้การเรียกร้องซึ่งแต่ละฝ่ายได้ยอมสละนั้นระงับสิ้นไป และทำให้แต่ละฝ่ายได้สิทธิตามที่แสดงในสัญญานั้นว่าเป็นของตน<\/p>\n
